PA Attorney General Fisher Files Court Action Seeking Serafini's Removal
HARRISBURG, Pa., Dec. 20 /PRNewswire/ -- Pennsylvania Attorney General Mike Fisher today filed a petition in Commonwealth Court seeking the removal of state Rep. Frank Serafini from office, saying his conviction of lying to a federal grand jury made him ineligible to serve in the General Assembly under Article II, Section 7 of the Pennsylvania Constitution.

On Dec. 16, Fisher sent a letter to Serafini calling on the legislator to resign by noon today, Dec. 20, or face legal action. On Monday afternoon, Fisher filed the petition seeking Serafini's removal after he failed to resign. The petition requests a preliminary and permanent injunction barring Serafini from holding a seat in the House of Representatives. Fisher also requested an expedited review of the matter.

``As Attorney General, it is my duty to uphold and enforce the Constitution,'' Fisher said. ``The Constitution is clear: No one convicted of perjury or other infamous crimes may hold a seat in the General Assembly. Therefore, I have asked the court to remove Rep. Serafini from office.''
